RESOLUTION NO. 001, Series of 2023

A RESOLUTION STRONGLY URGING THE GOVERNMENT OF THE PHILIPPINES TO TAKE IMMEDIATE ACTION ON THE TRAGIC LOSS OF LIVES OF MEMBERS OF THE MORO ISLAMIC LIBERATION FRONT (MILF) DURING THE LAW ENFORCEMENT OPERATIONS IN BARANGAY DAMAWATO, DATU PAGLAS, MAGUINDANAO DEL SUR ON JUNE 18, 2023

WHEREAS, the Criminal. Investigation and Detection Group – BARMM conducted a raid operation in the wee hours of the morning of June 18, 2023 in Barangay Damawato, Datu Pagias, Maguindanao del Sur, which resulted in the tragic killing of seven (7) members of the Moro Islamic Liberation Front (MILF);

WHEREAS, the victims, who are MILF members belonging to the National Guard Front, 11 Brigade, Inner Guard Base Command, namely: NASSER YOUSEF M. HUSAIN (34 yo), NORJIHAD M. HUSAIN (29 yo), NASRULLAH MAMAY SINGKALA (38 yo), IVAN PUMPUGAY (18 o), IZRAEL LAGUIAB (41 yo), MORSID MADIDIS (50
yo), and MAMA KARIM (53 yo), all succumbed to fatal gunshot wounds;

WHEREAS, this horrific incident happened in an MILF community where the
victims already filed their applications for amnesty, which program is an integral
component of the Comprehensive Agreement on the Bangsamoro between the
Government of the Philippines (GPH) and the MILF;

WHEREAS, this is only the latest of a string of law enforcement operations in
areas in the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM)
where loss of lives and injustice could have been prevented, had the concerned law
enforcement agencies observed the Operational Guidelines for the Ad Hoc Joint
Action Group (AHJAG);

WHEREAS, Item B (4) of the Annex on Normalization signed between the
GPH and the MILF states that: “(T)he International Monitoring Team (IMT), the GPH
and MILF Coordinating Committees on the Cessation of Hostilities (CCCH) and the Ad Hoc Joint Action Groups (AHJAGs), including the ceasefire Local Monitoring Teams and the AHJAG Team Sites, will continue to perform their functions, The Parties agree to undertake periodic review of these mechanisms to determine their transition into their appropriate mechanisms in the normalization process”;

WHEREAS, the absence of coordination by concerned law enforcement agencies in relation to this tragedy is a gross violation of the ceasefire agreement, and undermines the primacy of the peace process;

WHEREAS, the non-renewal of the Terms of Reference of the IMT since
January 2023 also impacts on the Implementation of cessation of hostilities, including violations of international humanitarian law and human rights;

WHEREAS, the MILF is never remiss in cooperating with the GPH on all matters related to the peace agreements, believing that the integrity of the peace process can only be preserved if both parties mutually and faithfully comply with the provisions of the peace agreements;

NOW THEREFORE, RESOLVED, AS IT IS HEREBY RESOLVED, that the MORO ISLAMIC LIBERATION FRONT CENTRAL COMMITTEE (MILF CC) submit the following points for the most immediate action of the GPH:

1. Urgently UNDERTAKE an impartial, honest, credible, and fair fact-finding. investigation by a third-party investigator;
2. Sanction the IMMEDIATE RETURN of the INTERNATIONAL MONITORING TEAM to ensure that ceasefire is preserved;
3. GENUINELY AND SINCERELY IMPLEMENT all aspects of the Normalization process; and
4. Immediately CONVENE (within July 2023) the Joint Peace Implementing
5. Panels of the GPH and the MILF in Kuala Lumpur, Malaysia, in keeping with the signed agreements, and towards efforts of resolving diverging views on some aspects of implementation.

RESOLVED FURTHER, that the MILF CC respectfully call on His Excellency, President Ferdinand Romualdez Marcos Jr., to give paramount importance to justice, peace and security, in considering the foregoing action points;

RESOLVED, FINALLY, that a copy of this Resolution shall be furnished to the Office of the President, the Department of National Defense, the Department of Justice, and the Office of the Presidential Adviser on Peace, Reconciliation, and Unity, for appropriate action.

APPROVED, this 20th day of June 2023, during the Special Meeting of the Central Committee held in Camp Darapanan, Simuay, Sultan Kudarat Maguindanao.
